California Acknowledgment

The form most frequently completed by a California Notary Public is the certificate of acknowledgement.  This certificate must be in the form set forth in the Civil Code section 1189.  The notary public certifies the following:

  • The signer personally appeared before the notary on the date indicated in the county indicated.
  • To the identity of the signer; and
  • The signer acknowledged executing the document.

California Jurat

The second most frequently completed certificate by a notary public is the Jurat, according to Government Code section 8202. The Jurat includes the wording “Subscribed and sworn to (or affirmed)." In the Jurat, the Notary certifies:

  • The signer personally appeared before the notary on the date indicated in the county indicated.
  • The document was signed in the notary public’s presence
  • Notary Public administered the oath or affirmation.
  • The identity of the signer was verified by state issued identification.

Certification of Power of Attorney

In California, a Notary Public can certify a copy of an original power of attorney.  A certified copy of a power of attorney has the same force and effect as the original power of attorney. (Probate Code section 4307).

The California Secretary of State provides suggested formats for the certification, and Rocklin Notary Public ensures that all certified copies conform with local recording requirements.
